GENERAL CONDITIONS


Object

The purpose of these general conditions is to regulate the Terms and Conditions of Use of the web platform for booking tours and tourist and leisure activities https://yellowtoursmadrid.com/es (hereinafter referred to as YELLOW TOURS MADRID) owned by TOURIST PRODUCTS MADRID 2015, SL.

Acceptance of the Conditions

Access the Platform YELLOW TOURS MADRID and book the activities offered, implies the acquisition of the condition of User of the Platform and the declaration that, as a User, you have read, understood and accept these General Terms and Conditions which define the rights and obligations ofYELLOW TOURS MADRID and the User in the contracting of tours and tourist and leisure activities of YELLOW TOURS MADRID.

Booking of activities

To make a reservation for the activities offered by YELLOW TOURS MADRID you must follow the process established in our Ventrata booking system. Specifically, you have to select the activity you are interested in, the date, time and number of people, and fill in the online booking form with the personal details requested. It is important that you check the information provided and correct any errors before confirming your booking, as once you have done so ("click" on the confirmation tab) you will not be able to modify your details. By completing this form, you are indicating that you have read and understood the description of the activity and accept these Terms and Conditions. We recommend that you take special note of the Cancellation Policy before making your booking. In addition, please note that in the event that activities are subject to restrictions, it is your responsibility to comply with the requirements of the activity and it is understood that this is the case when you make your booking. Once your booking has been paid for, it will be processed by YELLOW TOURS MADRID.

Booking confirmation

Depending on the activity booked, you will receive confirmation of your booking immediately, or within a maximum of 24 hours you will receive confirmation and your booking voucher by email. YELLOW TOURS MADRID makes every effort to quickly update the availability of activities but cannot always guarantee the availability of all activities for all proposed dates. For this reason, some activities need to be checked with the activity partner before we can send you confirmation of your booking. In these cases, you will receive the confirmation by email within a maximum of 24 hours of booking (the average time required also depends on the diligence of our partners). In the exceptional case that YELLOW TOURS MADRID is unable to confirm your booking, we will offer you alternative dates or other activities that may be of interest to you. If you are not satisfied with the options we offer you, you will have the possibility to cancel and receive a full refund of the amount you have paid. No compensation will be given if your chosen activity is not available.

Vouchers

Once we confirm your booking, you will receive a personalised YELLOW TOURS MADRID voucher by email, which you must show to the corresponding partner at the time of the activity. Your booking will only be accepted on presentation of a valid YELLOW TOURS MADRID voucher. YELLOW TOURS MADRID will provide electronic copies of the corresponding vouchers for each booking made. Please note that each activity has a separate voucher. It is your responsibility to keep the voucher and present it to the partner before the start of the activity, together with a valid photo ID. The voucher may be invalidated if the above is not complied with.

Prices, inclusions and exclusions

The price of the activities offered by the YELLOW TOURS MADRID platform includes V.A.T. and any other applicable tax at the rate in force at the time of booking the activity. The price includes everything detailed in the "Included" section in the description of each activity. The price of the activities does not include any extra or service not specifically mentioned in the "Included" section of the activity description.

Payments

To book an activity through the YELLOW TOURS MADRID, platform, you must pay the price indicated in the description of each activity at the time of booking. If you have a YELLOW TOURS MADRID discount code, it will be applied immediately at the time of payment. To do so, you only have to enter the discount code in the corresponding field of the form with your booking details. This field is clearly visible and identified on the booking form. You will not be charged any fees or commissions for processing your card payments. Your payment details (e.g. card number and expiry date among others) will be processed securely using a SSL security protocol, and will only be used to process your purchase or to issue refunds in the event of cancellation. The YELLOW TOURS MADRID Platform does not store your payment details nor does it have access to them, only you and the entities that process the payment in a secure and reliable manner will have access to them. In the event that you do not pay for the booked activity or you revoke the payment, YELLOW TOURS MADRID will waive any possible claim. If you make payment for your booking in a currency other than Euros, your bank or card company may charge fees for converting the payment from your currency to Euros, which will result in differences between the amount charged by the YELLOW TOURS MADRID Platform and the final amount charged to your bank account or appearing on your credit or debit card statement.

Amendments and corrections to reservations

To request modifications or corrections to your booking, please write to us at info@theyellowtour.com specifying the booking number, your name and the date of the booked activity. We will deal with your request as soon as possible. Please note that it is not possible for us to change or modify tickets for a special event, museum, theatre or show. Sales of these tickets are final and cannot be changed once the booking has been confirmed. All other requests for date changes or other modifications will be honoured, but are not guaranteed and are subject to the availability of our partners.

Cancellations and refunds

If you need to cancel a booked activity or request a refund, you should do so by sending an email to info@theyellowtour.com with the booking number, name and date of the activity. The cancellation policy for an activity varies according to the terms of the activity partner. The cancellation policy information for each activity is usually detailed in the description of the activity itself and on your booking voucher. However, in the event that the cancellation policy is not specified or there is an obvious error in the cancellation policy, cancellations and refunds will be governed by the following cancellation policy: 1. Cancellations less than 24 hours before the start of the experience: with penalty (full amount). 2. Cancellations more than 24 hours before the start of the experience: no penalty. *Option to substitute your ticket for another experience of equal or lesser value or for another experience of greater value by paying the difference between the tickets). *Similarly, YELLOW TOURS MADRID will not make any refund once the activity has started and is abandoned for any reason. The corresponding refund will be made between 24 and 48 hours from the cancellation of the activity in the same payment method with which you paid for the booking, which you will be notified via email. Once the order has been given, refunds made by debit/credit card may take 5 to 7 working days to appear in your bank account and up to 30 days in the case of some foreign cards.

Change or cancellation of an activity by YELLOW TOURS MADRID and its collaborators.

The partners of YELLOW TOURS MADRID reserve the right to cancel a specific activity without adhering to the established cancellation period if weather conditions, governmental actions, unforeseeable or unavoidable external circumstances endanger or make the activity impossible or much more difficult to carry out. In such cases, the partner itself, or failing that YELLOW TOURS MADRID , will notify you by email of such changes or cancellations and will propose either another date for the activity, or alternative activities that may be of interest to you. In the event that it is not possible to set another date or this or other activities that we propose are not acceptable to you, you will be entitled to a 100% refund of the amount of the reservation, excluding any compensation for damages or other claims. Occasionally, our partners make changes to activities, such as dates, times, prices, inclusions, coverage, age requirements, etc. As a consequence, YELLOW TOURS MADRID, on behalf of its partners, reserves the right to cancel, change or substitute any detail of the activities at any time and for any reason. Similarly, our partners reserve the right to make minor changes to the activity programmes if deemed necessary due to unforeseeable or avoidable circumstances, without this altering the essence of the activities or committing us to any reimbursement or compensation.

Applicable Law and Competent Jurisdiction

You accept that the law applicable to the operation of these General Conditions is Spanish law and that the Judges and Courts of the city of Madrid will be competent to hear any disputes arising from the interpretation or application of these conditions.
